Overview
The ihram for Hajj may only be entered during the Months of Hajj — Shawwal, Dhul-Qa'dah, and the first ten days of Dhul-Hijjah. This is a timing condition, because Hajj is fixed to the standing at 'Arafah on the 9th of Dhul-Hijjah.

الْحَجُّ أَشْهُرٓ مَّعْلُومَٰتٓ ۚ فَمَن فَرَضَ فِيهِنَّ الْحَجَّ فَلَا رَفَثَ وَلَا فُسُوقَ وَلَا جِدَالَ فِى الْحَجِّ'Hajj is [during] well-known months, so whoever has made Hajj obligatory upon himself therein [by entering the state of ihram], there is [to be for him] no sexual relations and no disobedience and no disputing during Hajj. Hadith
أَشْهُرُ الْحَجِّ شَوَّالٌ وَذُو الْقَعْدَةِ وَعَشْرٌ مِنْ ذِي الْحِجَّةِThe months of Hajj are Shawwal, Dhul-Qa'dah, and ten (days) of Dhul-Hijjah (Ibn 'Umar (RA)). And Ibn 'Abbas (RA) said: 'It is from the Sunnah that one should not enter ihram for Hajj except in the months of Hajj.'
Grade · The defining statements are athar (mawquf reports) of the Companions Ibn 'Umar (RA) and Ibn 'Abbas (RA), reported by al-Shafi'i and cited by Ibn Kathir. Ibn 'Abbas's (RA) statement 'it is from the Sunnah...' carries the ruling of a marfu' report (takes the status of the Prophet's (ﷺ) Sunnah). The Qur'anic basis (2:197) is qat'i in establishing that Hajj has 'well-known months.' It is not contested that these are the three months; the disputes are over the exact extent of Dhul-Hijjah and the effect of ihram assumed before them.
For Umrah
This restriction does not apply to 'Umrah. Q 2:197 confines Hajj to well-known months; nothing confines 'Umrah, which the majority hold valid on every day of the year. The one place the months matter for an 'Umrah is tamattu': a Mutamatti's 'Umrah must fall inside the months of Hajj and in the same season as his Hajj, or it is simply a separate 'Umrah. Applies to
Applies to the Hajj ihram of all three types: Ifrad and Qiran (single ihram assumed at the outer miqat during these months) and the second, Hajj-portion ihram of Tamattu' (assumed from Makkah on 8 Dhul-Hijjah, within the months). It does not restrict 'Umrah: 'Umrah ihram — including the 'Umrah of a tamattu' pilgrim — may be assumed at any time of the year.
If missed
This is a time condition, not an act that is 'omitted.' Consequences of mistiming: (a) Assuming Hajj ihram outside the months — Shafi'i: it does not convene as Hajj and converts to 'Umrah; Hanafi/Maliki/Hanbali: valid but makruh. (b) Attempting a specific Hajj rite outside its own appointed time (e.g. wuquf at 'Arafah on a day other than 9 Dhul-Hijjah) — that rite is invalid and the Hajj is missed (fawat al-Hajj), obliging the pilgrim to exit via 'Umrah, offer a hady, and make up the Hajj the following year. Missing the whole window means no Hajj that year. 'Umrah ihram is not restricted to these months and may be assumed year-round.
Timing & place
The window to validly assume ihram for Hajj: from the start of Shawwal (1 Shawwal) through the first ten days of Dhul-Hijjah (majority) — practically, one must enter Hajj ihram in time to reach the wuquf at 'Arafah on 9 Dhul-Hijjah. Individual rites still have their own fixed times within/after this window (wuquf: 9th; rami/nahr/tawaf al-ifadah: from the 10th). 'Umrah ihram is not restricted to these months.
Not a place-bound ruling; it is time-bound. (The place of assuming ihram is governed separately by the mawaqit.) It applies wherever the pilgrim enters ihram for Hajj — at the relevant miqat, or from Makkah for the Hajj portion of tamattu'.
Common mistakes
- •Confusing the 'months of Hajj' (the window in which Hajj ihram may be assumed) with the fixed times of the individual rites — the months are broad, but wuquf, rami, etc. each have their own day.
- •Believing 'Umrah is also restricted to these months (it is not — 'Umrah is valid year-round).
- •A tamattu' pilgrim thinking his Hajj ihram may be entered any time — it must be within the months (he assumes it on the 8th).
- •Assuming that entering Hajj ihram in, say, Ramadan or before Shawwal is simply fine — per the Shafi'i school it would take effect as 'Umrah, not Hajj.
Across the madhabs
Validity of ihram before the months: Two positions. (1) Shafi'i (with the Companions Ibn 'Abbas (RA), Ibn 'Umar (RA) and Jabir (RA)): ihram for Hajj is not validly convened as Hajj outside the months of Hajj; if assumed before Shawwal it does not count as Hajj and instead takes effect as an 'Umrah (it cannot substitute for the Hajj ihram). (2) Hanafi, Maliki and Hanbali: ihram for Hajj assumed before the months is valid as Hajj but is makruh (disliked).; Extent of dhul-hijjah: All agree the window includes Shawwal and Dhul-Qa'dah; they differ on how much of Dhul-Hijjah remains a valid time to begin Hajj ihram: Hanafi and Hanbali — the first ten days (through the 10th / Yawm al-Nahr); Shafi'i — up to the dawn (Fajr) of the 10th (the night of the Day of Nahr), since Hajj ihram must be assumed in time to reach the wuquf at 'Arafah; Maliki — the entire month of Dhul-Hijjah.
Notes
The wisdom is that Hajj is a time-specific act of worship (mu'aqqat) whose core rite (wuquf at 'Arafah) is fixed to 9 Dhul-Hijjah; the 'months of Hajj' define the outer window for validly entering its ihram. Scholars derive the ruling from 'faman farada fihinna al-Hajj' in 2:197 ('whoever undertakes Hajj therein'), reading 'undertaking' as entering ihram. Malik's inclusion of the whole of Dhul-Hijjah relates to the fact that some Hajj acts (e.g. tawaf al-ifadah) may validly be delayed through the month, not to any later start for the wuquf itself.
