Conditions & Rulings
Validity conditions, ihram prohibitions, the stages of exiting ihram, and expiation (fidyah/dam) rules — reference material spanning every Hajj type and Umrah.
Scope notes
- The ruling and virtue of 'Umrah (obligatory duty or emphasised sunnah?)حكم العمرة وفضلهاOn the Shafi'i and Hanbali view, a capable Muslim who never performs 'Umrah has left an obligation, like leaving Hajj — it remains a debt to be discharged. On the Hanafi and Maliki view there is no sin in never performing it, only a lost merit. There is no da…
- Visiting Madinah is not a rite of Hajj or Umrah (Ziyarah of the Prophet's (ﷺ) Mosque)زيارة المدينة المنورة والمسجد النبوي ليست من مناسك الحج والعمرةNo penalty whatsoever, and no sin. Skipping the Madinah visit carries zero consequence for the Hajj: it invalidates nothing, requires no dam and no fidyah, and incurs no sin — precisely because it was never part of Hajj to begin with. A pilgrim who completes …
Timing & procedure
- Ashhur al-Hajj (the Months of Hajj)أشهر الحجThis is a time condition, not an act that is 'omitted.' Consequences of mistiming: (a) Assuming Hajj ihram outside the months — Shafi'i: it does not convene as Hajj and converts to 'Umrah; Hanafi/Maliki/Hanbali: valid but makruh. (b) Attempting a specific Haj…
- Timing of 'Umrah (valid all year, and the virtue of 'Umrah in Ramadan)وقت العمرة وفضل عمرة رمضانNot an act that can be omitted — it is the rule fixing when 'Umrah may be performed. Practical consequence: because 'Umrah has no fixed season, a pilgrim who misses a particular time has lost nothing but a specific merit (e.g. the reward of an 'Umrah in Ramad…
- Miqat for 'Umrah for one already inside the Haram (al-Tan'im, al-Ji'ranah)ميقات العمرة لمن كان داخل الحرم (التنعيم، الجعرانة)Entering ihram for 'Umrah from inside the Haram (e.g. from one's hotel or from Masjid al-Haram itself) without going out to the Hill does not invalidate the 'Umrah, but it leaves the pilgrim in the same position as anyone who crossed a miqat without ihram: he…
- Declaring the type of pilgrimage (nusuk) in the Talbiyah at ihramتعيين النسك في التلبية (لبيك حجا / لبيك عمرة وحجا / لبيك عمرة)No penalty. Not voicing the type does not affect the validity of the Hajj or 'Umrah, because it is the intention (niyyah) that convenes the nusuk, not the spoken words. One who enters ihram without specifying (mutlaq) simply fixes the type before commencing t…
- Ishtiraat (stipulating a condition of release when entering ihram)الاشتراط عند الإحرام (اللهم محلي حيث حبستني)No sin or penalty for not making it — it is optional. Its consequence is felt only if the pilgrim is then actually prevented: one who stipulated may simply exit ihram owing nothing (no hady, no make-up), whereas one who did not stipulate becomes muhsar and, u…
- The Imam's four khutbahs (sermons) of Hajjخطب الحج الأربعNo penalty. These are the imam's sunnah sermons, not a personal rite of the individual pilgrim; omitting them does not invalidate anyone's Hajj and requires no dam or fidyah. This entry is informational/context describing what the imam delivers, not an act th…
- Repeating 'Umrah, and the gap between two 'Umrahsتكرار العمرة والمدة بين عمرتينNot an act that can be omitted — it is the rule on how often 'Umrah may be repeated. Practical consequence: performing a second 'Umrah sooner than a school would prefer costs nothing in law. The 'Umrah is valid, no dam is owed and nothing is repeated; at most…
Prohibitions of ihram
- Prohibitions of Ihram (Mahzurat al-Ihram)محظورات الإحرامRead as the ruling if the prohibition is violated. Deliberate violation without excuse is sinful and, for most items, obligates expiation; violation out of genuine need (illness, lice, heat) is not sinful but still obligates fidyah. The consequences are tiere…
- Sexual intercourse before the first tahallulالجماع قبل التحلل الأولRead as the ruling if the prohibition is violated. Deliberate sexual intercourse (jimāʿ) before the first taḥallul carries four consequences, per the fatwa of the Companions and the majority: (1) the Hajj is invalidated (fāsid) — the only iḥrām violation with…
Expiations (Dam / Fidyah)
- Fidyat al-adha (expiation for shaving/removing hair during ihram out of illness or harm)فدية الأذىThe Hajj/'Umrah remains valid — shaving out of harm is a permitted concession, not a rite that can be 'omitted' and not, by itself, sinful. What is owed is the fidyah itself, which becomes a due obligation (a debt) that must be discharged by one of the three …
- Jaza' al-sayd (penalty / expiation for killing land game while in ihram)جزاء الصيدKilling land game does not invalidate the Hajj or 'Umrah, and the ihram remains intact. What is incurred is the jaza (kaffarah), which becomes a due obligation (a debt) discharged by one of the three options in Qur'an 5:95. Deliberate hunting is also sinful, …
- Dam (compensatory sacrifice) for omitting a wajib act of Hajj or Umrah — dam jabr / dam al-jubranدم جبر (دم ترك واجب من واجبات الحج أو العمرة)This item is itself the consequence (the dam) of omitting a wajib. The Hajj remains valid — omitting a wajib is never Hajj-invalidating (only omitting a rukn is). What is owed is the dam itself, which becomes a due obligation (a debt): a sheep/goat, or a one-…
Validity conditions
- Conditions for a valid Tawaf (Shurut sihhat al-Tawaf)شروط صحة الطوافIf a mechanical condition is missing — fewer than seven circuits, starting/ending other than at the line of the Black Stone, keeping the Ka'bah on the right, or passing inside the Hijr Isma'il — the tawaf is invalid and must be repeated; where the tawaf is th…
- Conditions for a valid Sa'i (Shurut sihhat al-Sa'i)شروط صحة السعي بين الصفا والمروةIf a mechanical condition is missing — fewer than seven traverses, starting at Marwah instead of Safa, not covering the full distance between the two hills, or performing sa'i before a valid tawaf — the sa'i is invalid and must be repeated. Because sa'i is a …
Releasing from ihram (Tahallul)
- Tahallul of 'Umrah (the single, complete release from ihram)التحلل من العمرةNot an act that is performed or omitted — it is the automatic legal consequence of completing the 'Umrah's rites. Practical import: before it, every ihram prohibition binds (sewn/fitted clothing and covering the head for men, perfume, cutting hair or nails, h…
- First tahallul (the minor/lesser release from ihram)التحلل الأصغر (التحلل الأول)Not an act that is 'performed' or 'omitted' — it is an automatic legal consequence of completing the requisite rites. Practical import: until the first tahallul is reached the pilgrim remains fully in ihram, so doing any ihram-prohibited thing (cutting hair o…
- Second tahallul (the major/greater, complete release from ihram)التحلل الأكبر (التحلل الثاني)The second tahallul is not 'performed'; it is the automatic result of completing the last outstanding act — in practice Tawaf al-Ifadah. If that act is never done, the second tahallul never occurs: marital intercourse remains prohibited indefinitely and the H…
